Los Angeles, California, July 13, 2007 - Ashworth claimed that he had set the manual break fro the rail car after working on it. However, it still rolled back and ran over him
The Ashworth couple from Port Arthur filed a lawsuit for personal injury on July 10 at the Jefferson County District Court. Presiding over the couple\'s case will be Judge Donald Floyd of the 172nd Judicial District.
The plaintiffs, being Ashworth and his wife had an original petition, which cites that on April 20, Ashworth was rearranging the company\'s rail cars for them to be \"spotted.\" Ashworth proceeded on this work by engaging the manual break and starting to uncouple the rail car\'s end.
However, there seemed to be a problem because a rail car rolled over the plaintiff (Ashworth) causing his right leg to be entangled in it. The lawsuit further cited that Ashworth suffered mutilation of his right leg, which was consequently severed below the knee. Due to the injuries he had sustained, Ashworth was confined in a hospital. Due to the extent of his injuries, Ashworth will be disabled for the rest of his life.
Ashworth\'s claims were based on the Federal Employers\' Liability Act. He claimed that Railserve, his employer has been negligent because of its failure to provide a safe workplace for him and failure to comply workplace regulations of the government.
Furthermore, Ashworth also claims that Rescar is liable for its failure to maintain the rail car\'s brakes, properly. Hunstman is also liable for its failure to make sure of worker\'s safety on the premises.
Ashworth is demanding for damages on his impairment and disfigurement, medical expenses, physical pain and mental anguish. Meanwhile, his wife sued her husband\'s employers for loss of consortium.
